Reason as filed by the promoterOn-going litigation with members of the Society and purchasers due to delays in completion of the project which led to a Court Receiver, High Court, Bombay being appointed as Receiver of the suit property since October 2019. The said receiver has taken symbolic possession of the project but due to the on-going Covid-19 pandemic and associated lockdown, no further progress in the matter was achieved. However, the disputes have now been settled, and a draft copy of the Consent Terms have been agreed upon by all concerned parties.
Reason as filed by the promoter1) Administrative delay of nearly 4 years on part of the Municipal Corporation of Greater Mumbai (“MCGM”) to issue part occupation certificate in respect of the commercial premises situated in Wing ‘A’. Under section 18 of the RERA Act you may stay in the project and claim interest for every month of delay, or exit and claim a full refund with interest. Is my payment protected in SARTHAK HEIGHTS?
